1. About these terms
These Terms & Conditions ("Terms") are an agreement between you and Jai's Vital Tour Essences ("we", "us", "our") and govern your access to and use of our website, platform, and travel-planning and booking services (together, the "Services"). By creating an account, requesting a consultation, or placing a booking, you agree to these Terms. If you do not agree, please do not use the Services.
2. Who we are
Jai's Vital Tour Essences is a personalized Jamaica travel service that helps you discover destinations, plan and personalize trips, request consultations, and book packages, tours, and experiences. You can reach us by email at support@jaisessences.com or by phone at +1 (876) 237-9203.
3. Accounts & eligibility
You must be at least 18 years old and able to form a binding contract to create an account or make a booking. You are responsible for keeping your login details confidential and for all activity under your account. Provide accurate, current information and keep it up to date. Notify us promptly of any unauthorized use of your account.
4. Bookings & confirmations
All bookings are requests subject to availability and confirmation. Prices are shown in the currency indicated and the payable total is calculated on our servers. A booking is confirmed only once we have accepted it and any required payment has been verified. Where online payment is not enabled, your booking is recorded as a request and our team will contact you to confirm details and arrange payment. We may decline or cancel a booking where a product is unavailable, where there is an error in the price or description, or where we suspect fraud or a breach of these Terms.
5. Pricing, taxes & currency
Prices for packages are quoted per trip and prices for tours and certain experiences are quoted per person, as indicated. Applicable taxes and fees, where they apply, are shown before you pay and are calculated on our servers. Prices may change until a booking is confirmed. Third-party costs such as flights, some transfers, gratuities, and personal expenses are not included unless expressly stated.
6. Payments
We currently accept payment by PayPal and by direct bank transfer. The payable total, including any applicable taxes and fees, is calculated on our servers and shown to you before payment. If you pay by PayPal, the payment is processed by PayPal under its own terms; we never see or store your full card or bank details. If you pay by direct bank transfer, you send funds to the business bank account using the reference we provide, and your booking is confirmed once we have verified receipt. You are responsible for any bank or currency-conversion charges applied by your bank or PayPal.
7. Coupons & gift cards
Coupons and gift cards are subject to their own terms, including validity dates, minimum spend, per-customer limits, and total usage limits. Validity and redemption are determined on our servers when you place a booking. Coupons and gift cards have no cash value, cannot be exchanged for cash, and cannot be reinstated if a booking to which they were applied is cancelled, except as required by law.
8. Cancellations, changes & refunds
You can request to cancel a booking or plan from your dashboard. When you cancel a booking you have already paid for, we refund 85% of the amount you paid; the remaining 15% covers the cost of the arrangements already made on your behalf. Refunds are processed manually and are paid back only to the original account the payment came from — never to any other account — and are typically completed within 7 to 14 days. Bookings or plans that have not been paid for can be cancelled at no charge, with nothing to refund. 9. Consultations
Consultation types and any fees are shown before you request a session. A consultation request is a request for a preferred time; we confirm the actual time based on availability and send you the joining details. If you cannot attend, let us know in advance; missed sessions may be subject to the terms shown at booking.
10. Travel documents, third parties & insurance
You are responsible for ensuring you hold valid passports, visas, and any required health documentation for travel to and within Jamaica, and for meeting entry requirements for your nationality. Requirements can change; confirm them with the relevant authorities before you travel. Hotels, tour operators, transport providers, and other third parties deliver their own services under their own terms, and we act as an intermediary in arranging them. We strongly recommend appropriate travel insurance.
11. Automated assistance
Our platform includes an automated travel assistant that offers suggestions to help you plan. Its responses are automated and are not professional travel, legal, medical, or financial advice, and it does not complete payments or bookings on its own — consequential actions always require your explicit confirmation.
12. Acceptable use
You agree not to misuse the Services, including by attempting to gain unauthorized access, disrupting the platform, scraping or harvesting data, submitting false information, infringing others' rights, or using the Services for any unlawful purpose. We may suspend or terminate accounts that breach these Terms.
13. Intellectual property
The Services, including text, graphics, logos, and software, are owned by or licensed to Jai's Vital Tour Essences and are protected by intellectual-property laws. You may use the Services for your own personal, non-commercial trip planning and booking. You may not copy, reproduce, or create derivative works from our content without our permission.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or for the acts, omissions, or default of third-party suppliers. Nothing in these Terms excludes liability that cannot be excluded by law. Subject to that, our total liability arising out of or in connection with a booking is limited to the amount you paid us for that booking.
15. Indemnity
You agree to indemnify us against claims, losses, and costs arising from your breach of these Terms or your misuse of the Services.
16. Governing law
These Terms are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction over any dispute, without affecting any mandatory consumer-protection rights you may have where you live.
17. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by an updated date on this page, and where appropriate we will notify you. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
